AGREEMENT AND RELEASE OF LIABILITY

In consideration for being permitted to utilize the land and facilities owned and leased by:

Stokes Farms (owner) / Tokay Radio Control Modelers (lessee) hereinafter
collectively referred to as “Released Parties”

Located at:
Tyler Island – Latitude 38 Deg 12 Min 19 Sec Longitude 121 Deg 31 Min 33 Sec

And to engage in the hobby of flying remote controlled aircraft, and related activities (hereinafter collectively referred to as “RC Aircraft
Operation”)

Hereby agree as follows:

1. I hereby RELEASE AND DISCHARGE the Released Parties from any and all liability, claims, demands or causes of action that may hereafter have for injuries and damages arising out of my participation in RC Aircraft Operation including but not limited to losses CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

2. I further agree that I will not sue or make claim against the Released Parties for damages or losses sustained as a result of my participation in
RC Aircraft Operation or using the property.

3. I also agree to INDEMNIFY, DEFEND AND HOLD THE RELEASED PARTIES HARMLESS from all claims,
judgments, and costs, including attorney’s fees incurred in connection with any action brought as a result of my participation in RC Aircraft
Operation and entering the property.

4. I understand and acknowledge that RC Aircraft Operations have inherent dangers that no amount of care, caution, instruction, or experience
can eliminate and I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN RC Aircraft Operation WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

5. I have been advised and recognize that my RC Aircraft Operations are not covered by any personal accident or general liability insurance policy issued to the Released Parties.

6. I hereby expressly recognize that this Agreement and Release of Liability is a contract pursuant to which I have released all claims against the
Released Parties resulting from my operation of RC Aircraft including any claims caused by negligence of the Released Parties.

I HAVE READ THIS AGREEMENT – RELEASE OF LIABILITY, FULLY UNDERSTAND ITS CONTENTS, AND SIGN IT OF MY OWN FREE WILL. e

FIELD RULES

1) Each new member must fly for the first time at the club field with a club member who will review the club safety and field rules, AMA safety rules, and ascertain that the new member can adequately and safely fly the aircraft.

2) Guests shall be allowed flying privileges at the club field only if a TRCM member is present and will assume responsibility to see that club rules are observed. This includes verification that the guest possesses AMA membership and has signed a TRCM Release of Liability form. Any guest utilizing the flying field for more than three occasions shall be asked to present themselves for membership.

3) Complete a satisfactory range check of your equipment, and preflight your plane.

4) NO takeoffs from the pit or taxiway area

5) Flying is NOT allowed above the Pit and Parking area.

6) DO NOT stand on the Runway while Flying. Use the Pilot’s stations behind the safety barrier.

7) ALWAYS announce your intention for takeoff or landing to the other pilots.

8) Dead stick aircraft have landing priority over all other aircraft. Landing aircraft have priority over aircraft that are taking off. Be courteous and communicate with the other pilots when retrieving your aircraft.

9) Engines will only be run at the Start Up Area and the Run Up area only.

10) Mufflers are REQUIRED on all Aircraft. (Electric is exempt)

11) Alcoholic beverages are NOT permitted on the field at any time.

12) NO Smoking

13) The last person to leave the field will lock the gate.

14) The Safety Officer and all members will ensure compliance with these rules.
